Plaintiff sues to recover damages sustained by her automobile while in the possession of and operated by a bailee upon the highway. She claims that the damage was caused by a depression in the highway for which the defendant was responsible.

The case is submitted to this court upon a certificate of the Judge of the Superior Court that questions of law of sufficient importance are involved to justify such submission, — the question of liability to be decided upon so much of the evidence reported as is legally admissible.
