The appellee, O. R. Houghton, plaintiff below, instituted this suit against M. Totten, appellant, defendant below, alleging that he and the appellant entered into a certain building contract in writing wherein the appellant agreed to furnish all labor and material, including the foundation, and build a certain apartment house for the appellee, according to certain plans and specifications, a portion of the specifications being set out in the plaintiff’s petition, a breach of which was alleged, to the plaintiff’s damage in the sum of $4,500, alleged to be the reasonable cost of installing and…
