MEMORANDUM

TENNEY, District Judge.

In this action by plaintiff Randolph Phillips (“Phillips”) to recover the “reasonable value” of his services as successful attorney pro se in an earlier suit, a number of motions are currently pending. Defendant Investors Diversified Services, Inc. (“IDS”) has moved for a dismissal of the amended complaint pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure (“Rules”) or, in the alternative, for summary judgment under Rule 56.
