Security State Bank (“SSB”) moves for summary judgment on the trustee’s complaint against itself and Whitham Farms Feedyard, LP (“Whitham”). The trustee in bankruptcy, Steven Speth, filed an adversary complaint under Fed. R. Bankr.P. 7001(2) seeking a determination of the validity, priority, and extent of defendants’ respective interests in certain proceeds from the trustee’s sale of debtor Sunbelt Grain WKS, LLC’s (“Sunbelt”) grain inventory and asserting its 11 U.S.C. § 544 rights as a hypothetical bona fide purchaser.
