STATEMENT OF FACTS

Thomas Agresti, plaintiff and Chapter 7 trustee in this bankruptcy case, brings this motion requesting that this Court enter an order to transfer into this Court another bankruptcy case presently pending in the U.S. Bankruptcy Court for the Southern District of Ohio. EBAR East, Inc., defendant and the Chapter 11 debtor in the other bankruptcy case, objects to plaintiffs motion and has moved for its dismissal.
