OPINION

This case had its origin in the Court of Common Pleas of Montgomery County, Ohio, resulting in a finding of the court sustaining the demurrer of the defendant, filed on the ground that the court has no jurisdiction of the subject of this action and because said amended petition does not state facts to show a cause of action. Court further states in its entry that being of the opinion and finding that the defects in the. first amended petition and apparent on the face thereof, can not be remedied by amendment, the court dissolves the temporary restraining order and…
