POEEENBARGER, JUDGE:
Joseph Prater, having been convicted, in the circuit court of Webster County, on the 13th day of November, 1901, of voluntary manslaughter, on an indictment for murder, complains of the verdict and judgment against him. The case -is peculiar *135and difficult, involving some 'very nice questions of law.
