This is an action for a broker’s commission, brought by plaintiff, C. H. Herren, against the Oklahoma Natural Gas Company. The action was tried to the court without a jury, and at the conclusion of all the evidence the trial court overruled defendant’s motion for a directed verdict, and rendered judgment for plaintiff on a quantum meruit basis. Defendant appeals.
Defendant contends, (1) that plaintiff’s action was barred by the statute of limitation, (2) that the trial court erred in rendering judgment for plaintiff in quantum meruit. We consider the last contention decisive.
