MOFFAT, Justice.

Appeal by the New York Life Insurance Company, plaintiff below, from a judgment in favor of defendant for the face value of a policy of insurance issued on the life of Eldon A. Grow, at age 26, in which the defendant, his wife, was named as beneficiary. The policy was issued and dated September 5, 1989, and delivered to the insured on or about September 9, 1989. The insured died July 3, 1941, from an attack of acute congestive heart failure. His beneficiary filed with the Insurance Company proof of death and demanded payment of the face value of the policy.
