I. INTRODUCTION
In January 2011, Plaintiff Pierre E. Saint-Fleur, a black man of Haitian descent and a lieutenant colonel in the California Army National Guard, learned that he had not been promoted to the rank of colonel or appointed to the position of State Chaplain. Plaintiff Saint-Fleur sought redress from the Army Board for Correction of Military Records (“ABCMR” or “Board”), alleging that he was passed over for promotion because of his race and national origin.
