William H. Truette was employed by the plaintiff in error, hereinafter referred to as the defendant, in October, 1914, as a lineman to keep up the telephone system operated by the defendant in connection with its railroad business. The defendant was a rail*154road corporation operating a line of road from Mulberry in Polk County to Boca Grande in Lee County, both within this State. A large part of the defendant’s business, both freight and passenger, was interstate. One witness said that about seventy-five per cent, of the business was of that character.
