The plaintiff in error brought an action against the Railroad Company for damages for the wrongful death of her husband. Upon the conclusion of the testimony the court instructed a verdict for the defendant which was rendered and judgment was entered for the defendant.

The plaintiff moved for a new trial and in arrest of judgment both of which motions were denied and she thereupon took a writ of error.
