MEMORANDUM OPINION AND ORDER

HAIGHT, Senior District Judge.

Atlantic Mutual Insurance Company (“Atlantic Mutual”) brought this complaint in admiralty as subrogee of its insured, Johnson & Johnson Medical Inc. (“J & J Medical”), to recover the amount of a claim it paid to J & J Medical under J & J Medical’s insurance policy with Atlantic Mutual. The $95,342.50 claim represented the value of 5566 cases of damaged bandage dressings that defendants had agreed, pursuant to a bill of lading, to transport from the port of San Juan, Puerto Rico to J & J Medical’s facility in Sherman, Texas.
