The plaintiff-appellant, Diane L. Lindemann, brought a wrongful termination action against her former employer, the Mobil Oil Corporation (“Mobil”), alleging that Mobil terminated her employment in violation of section 510 of the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1140. Mobil filed a motion for summary judgment, and the court granted the same on September 23,1996.
