The defendant, Odell Hooper, was convicted by a jury of the crime of robbery of the first degree and sentenced to San Quentin for the term prescribed by law. His motion for new trial was denied. From the judgment and from the order denying a new trial this appeal was perfected.
There is ample evidence to support the verdict and judgment. The only point urged on appeal is that the defendant was deprived of an impartial trial and due process by prejudicial conduct of the trial judge in discrediting defendant’s testimony at the trial by his observations affecting the credibility of the witness,…
