So far as the bill of exceptions shows, only one of the defendants filed a demurrer to the petition. The learned *283judge who presided overruled the demurrer, and in his order stated the allegations of the petition and his reasons for overruling the demurrer, as follows:

“Plaintiff brings this action against the Noble-Beveridge Company and the General Fire Extinguisher Company for the homicide of her husband.
