Defendant GNOC t/a The Grand (the Grand) applied to the Atlantic City Planning Board (the Board) for preliminary and final site plan approval for an expansion (the project) of defendant’s hotel. Phase I of the project received approval from the Board on March 1, 1995. On July 19, 1995, a public hearing was held and the Grand’s Phase II application was approved.
