The bill of exceptions which brought this case before the Supreme Court was filed as a writ of error to a judgment rendered by his Honor, John D. Humphries, who, in a proceeding in the nature of a writ of quo warranto, refused to oust his Honor, Claude C. Pittman, from the office of judge of the superior courts of the Cherokee Circuit. Judge Pittman was elected judge of the Cherokee Circuit in November, 1932, for the constitutional term of four years and until his successor should qualify.
