A quo warranto inquires into the right of any person to any public office the duties of which he is in fact discharging, but must be granted at the suit of some person either claiming the office or interested therein. Code, § 64-201. It appears that in the general election in November, 1938, Honorable M. J. Yeomans was duly elected attorney-general for the State of Georgia for a term of two years to run concurrently with that of the Governor, and to end on December 31, 1940.
