MEMORANDUM AND ORDER

NEWCOMER, District Judge.

This is a Civil Rights suit against Philadelphia police officers, the City of Philadelphia, the mayor and the police commissioner. The complaint alleges that the plaintiff was a passenger in an automobile when defendant police officer Devlin approached the car and demanded identification from the plaintiff. While plaintiff was providing identification, an unarmed starter pistol became visible in plaintiff’s jacket pocket, at which point plaintiff was arrested.
