This matter came to be heard on cross-motions for summary judgment filed by The General Cable Company (General Ca ble), the debtor, Altek Systems, Inc. (Altek) and the Pioneer Bank and Trust Company (Pioneer Bank). This case is ripe for decision because the parties have stipulated to the relevant, material facts; thus there is “no genuine issue as to any material fact.” 1
