This case is before the court now on the motion of the defendants to dismiss the .plaintiffs bill of complaint. The first reason assigned in support of that motion is: “Upon the facts stated in the complaint this court has no jurisdiction of said action because the requisite diversity of citizenship is not shown to exist.”
