This prosecution for subornation of perjury is here upon the certification of certain questions arising as follows: October 13, 1925, two indictments were returned against defendant to which he demurred. The demurrers were overruled and the cases set for trial. But there was so much doubt about the first indictments that the county attorney, without any order of court, resubmitted the matter to the same grand jury which returned the original indictments.
