This suit is a so-called “action over,” brought by the Sherman House Hotel Company, a corporation, hereinafter referred to as the hotel company, against the Butler Street Foundry & Iron Company, a corporation, hereinafter referred to as the iron company, to enforce, as it is claimed, the ultimate liability of the iron company for its negligence while in the employ of the hotel company, which negligence caused an injury to Charles P.
