Petitioners (opponents of the land use decision under review) and cross-petitioners (applicants for that land use decision) seek review of an opinion and order of the Land Use Board of Appeals (LUBA). LUBA remanded a county ordinance that approved comprehensive plan and zoning ordinance amendments to allow placement of a 50-room luxury hotel in an agricultural area. LUBA concluded that the county insufficiently justified its land use decision under state policies that inhibit the siting of urban development outside the urban growth boundaries of cities.
