BURROUGHS, J., pro tem.
This is an action upon a contract alleged in the complaint to have been entered into between the plaintiff and the defendants. The cause was tried by the court with a jury and a verdict in favor of the defendants was returned. Judgment was entered in accordance with the verdict. The plaintiff appeals.
The appeal is based upon the ground that the jury was not justified in finding for the defendants because the uncontradicted testimony of the plaintiff shows that he accepted the defendants’ offer and that therefore the parties were bound by a contract. The offer referred…
