On December 19, 1980, the Pennsylvania General Assembly amended the Public Welfare Code by adding a section1 (hereinafter Act of 1980) which provided that no funds of the Commonwealth and no federal funds appropriated by the Commonwealth should be used to fund abortions unless (1) a physician certified that the life of the mother would be endangered if the fetus was carried to full term or (2) the pregnancy resulted from rape or incest when such rape or incest is reported promptly2 to a law enforcement agency or public health service.
