Plaintiff Marc S. Kirschner, in his capacity as Trustee of the Refco Litigation Trust, originally filed this action in the Circuit Court of Cook County, Illinois, asserting claims under Illinois state law against certain Refco insiders, professionals, and advisors for, inter alia, fraud, breach of fiduciary duty, and malpractice. Certain defendants (the “Removing Defendants” 1 ) removed the action to the United States District Court for the Northern District of Illinois on the ground that the case is “related to” Refco’s Chapter 11 bankruptcy,…
