Appeal by defendant from a judgment of the Supreme Court, Kings County, rendered January 31, 1975, convicting him of grand larceny in the third degree and petit larceny, upon a jury verdict, and imposing sentence. Judgment reversed, on the law and as a matter of discretion in the interest of justice, and new trial ordered. On December 11, 1975, shortly before the commencement of the defendant’s trial, a hearing was held pursuant to CPL 670.20 to determine whether the complainant’s testimony, given at a preliminary hearing in the Criminal Court should be read into evidence at the trial in lieu…
