Plaintiff Patricia Kilby-Robb alleges that during late 2010 and early 2011, her employer, the U.S. Department of Education (“DOE” or the “Department”), engaged in race- and age-based discrimination and retaliation, in violation of Title VII of the Civil Rights Act, 42 U.S.C. § 2000e-16(a), and the Age Discrimination in Employment Act (“ADEA”), 29 U.S.C. § 633a(a).
