Appellee was injured at a street and railway crossing, by one of appellant’s locomotives, for which injury he recovered a judgment in the Wayne Circuit Court. This appeal is prosecuted to reverse the judgment on the follow*664ing grounds: (1) The trial court erred in overruling appellant’s demurrer to the complaint; (2) the court erred in overruling appellant’s motion for a new trial.
