The matter before the Court is the complaint, filed, on July 23, 1985, by Robert Fitzgerald, Trustee (the “Trustee”) of Edward Harvey Company Inc. (the “Debtor”), against the above named defendants (“the defendants” or “Cheverie”). Through his complaint, the Trustee seeks a determination that the termination of the Debtor’s leasehold interest in the ground floor premises of 15 School Street, Boston, Massachusetts, pursuant to a Settlement Agreement dated February 22, 1985 between the Debt- or and Cheverie, was a fraudulent conveyance.
