STEPHEN F. WILLIAMS, Circuit Judge:

Petitioner Jean-Pierre Bell seeks review of a final order issued by the Department of Agriculture, in which he was found to have been “responsibly connected” with Sunrise Produce, an agricultural products marketing company that violated the Perishable Agricultural Commodities Act of 1930, 7 U.S.C. § 499a et seq. (1988). Because we find that the Department erroneously applied a per se standard to find Bell “responsibly connected” to Sunrise, we remand the ease to the Department for further proceedings…
