The Opinion and Order in these cases dated July 22, 2008 is hereby vacated and replaced with this Amended Opinion and Order.

I. INTRODUCTION

Twelve large gasoline refiners and their related corporate entities, who together account for approximately seventy percent of the named defendants in these cases, have agreed to pay plaintiffs in fifty-nine actions approximately $422 million to settle claims arising from contamination of public and private well water with the gasoline additive methyl tertiary butyl ether (“MTBE”). 1 In addition,…
