In an action, inter alia, to enjoin defendants from engaging in false and deceptive business practices, defendants appeal from so much of an order of the Supreme Court, Orange County (O’Gorman, J.), dated September 18, 1980, as granted plaintiff partial summary judgment. Order affirmed insofar as appealed from, without costs or disbursements. The affidavit of the Assistant Attorney-General in support of the motion pursuant to CPLR 3212 for summary judgment, was founded upon documentary evidence and was therefore sufficient as a matter of law.
