This cause comes before the Court pursuant to Plaintiff Douglas’s Motion for Summary Judgment as to Liability Only on Counts I and II (Doc. # 35), Defendant United States’ Motion for Summary Judgment (Doc. # 45), and the respective responses in opposition thereto (Docs. # 46, 47).
