BAKER, Judge.

The appellant was indicted on the 8th day of November, 1924, in district court of Hemphill County charged with murdering Clyde Williams on or about the 12th day of October, 1924, and on change of venue was tried in district court of Ochiltree County November 17, 1924, and convicted on the 19th of November 1924 of murder and his punishment assessed at twenty years confinement in the penitentiary.

Briefly stated, the record discloses that the appellant is a negro and the deceased was a white man, and at the time of the homicide the appellant, deceased and quite a number of negroes…
