HARPER, Judge.

Appellant was prosecuted, charged with murder and convicted of manslaughter.

In this case it appears that Alfred Diffie, a young man, called to see a daughter of appellant one Saturday night, and the next night she went t-o church with her parents, Alfred Diffie accompanying her home. Her mother and father getting home first, lighted the parlor, and retired to their room, her father undressing preparatory to retiring.
