Some three weeks before the accident, a clerk of one Comeau, who conducted a drug store, made arrangements with an employee of the defendant, who conducted a filling station located across the street from the drug store, to have the morning newspapers left at the filling station and to permit Comeau’s customers to purchase them, leaving the money near the papers each morning until the clerk came about eight o'clock and took the unsold papers *441and the change to the drug store, which he then opened up for the day’s business.
