MEMORANDUM OF OPINION (WRITTEN OPINION)

RUSS KENDIG, Bankruptcy Judge.

Defendant Caroman Finance Account, Inc. (hereafter “Caroman”) filed a motion for summary judgment on April 13, 2006. Following an approved extension of time, Plaintiff filed a response on May 5, 2006, to which Defendant replied. The pleadings are now before the court for decision.

The court has jurisdiction over this matter pursuant to 28 U.S.C. § 1334(b) and the general order of reference entered in this district on July 16, 1984. This is a core proceeding under 28 U.S.C. § 157(b)(2)(F). Venue is appropriate under 28 U.S.C.…
