Plaintiff in error, Tyree Gidens, for convenience referred to as the defendant, was prosecuted by information for an assault with intent to kill by means of an open knife, under the provisions of section 1756, Comp. Stat. 1921.

The injured party was Jared Little, the prosecuting witness in the trial court. The state’s evidence shows that there was a community singing entertainment at the Oak Grove schoolhouse, where the defendant, the prosecuting witness, and many others had assembled.
