The plaintiff in error, Will Bus-sell, was tried and convicted at the June, 1911, term of the district court of Love county on a charge of assault with intent to hill, and his punishment fixed at imprisonment in the state penitentiary for one year and one day.
The charging part of the information upon which this conviction is based is as follows:
