— -This action was brought to recover damages for trespass upon land owned by the plaintiff.
The defendants were three corporations and Charles H. Frye, individually. Before the case was submitted to the jury, all the corporations were dismissed out of the action, and only the individual defendant remained. The jury returned a verdict in favor of the plaintiff in the sum of seven thousand dollars. The defendants moved for judgment notwithstanding the verdict, and, in the alternative, for a new trial; both of which motions were overruled.
