The appellant, Danna Roxanne Pitts Read, was indicted for murder but was convicted of the lesser offense of manslaughter, under § 13A-6-3, Code of Alabama 1975. She was sentenced to 17 years in the state penitentiary and was ordered to pay $2,638 in restitution.
The state's evidence tended to show that on April 4, 1994, a fight occurred between the appellant and her husband, Gaylon Wayne Read, as the appellant was attempting to retrieve her possessions from the apartment she shared with Read and her daughter Roxanne.
