SULLIVAN, Judge.

Tammie Semar and her husband, Kenneth, filed suit against The Kroger Company, its insurer, and several store employees, alleging that Mrs. Semar was injured when she fell on a bag of cookies that protruded from under a shelf into an aisle at a Kroger store in Lake Charles, Louisiana. Defendants filed a motion for summary judgment, arguing that Plaintiffs would be unable to meet their burden of proving that the store had actual or constructive notice of the cookies on the aisle floor.
