HELLENTHAL, District Judge.
Judgment was entered in this cause on the 15th day of September, 1938, at which time the judgment roll was made up. On the 8th day of November, 1939, Minda Hilty filed a petition herein to vacate the judgment, in which petition she alleges: that Al. Hilty, who was made a defendant in the original case, had died on September 16, 1937; that she, the petitioner, is the widow of said Hilty; that Hilty died intestate without lineal descendants and at the time of his death was seized and was entitled to the possession of one-eighth interest in a certain placer mining…
