Huffman, commenced a suit in the ■circuit court for Harney County against the defendant, Fannie E. 1. It is contended by the defendant’s counsel that, as the plaintiff voluntarily transferred his right of possession to the public land, he thereby relinquished all claim to the premises; and, this being so, no error was committed in ■denying the motion. The court, in granting the divorce, vacated as fraudulent and void the pretended assignments on the assumption that they were made in secret trust for the plaintiff’s use.
