NETERER, District Judge.

The three last-named cases were heretofore submitted and exceptions sustained. Petition for rehearing is filed. The first two cases are now submitted upon exceptions.

The libels are practically the same. Each seeks to recover an amount alleged to be due under a provision contained in a contract at a given rate of affreightment per thousand feet, with a provision “in the event regular intereoastal carrier moves similar cargo at lower rate, such lower rate to be applied.” The libels were filed about seventeen months after the cargo was carried, delivered, and paid for.
