Error to the Circuit Court of Mobile. Tried before the Hon. Lyman Gibbons. Parham brought an action on the case against the plaintiffs in error, as co-partners and owners of the steamboat Wm. R. King, for the value of a slave named June, who was hired as a deck hand on the boat, and who, it was alleged, came to his death by the negligence of the defendants. It appears from the record, that, in order to show the want of skill on the part of Cook as a steamboat captain, the deposition of a witness who had acted as such for many years, and was acquainted with Cook, was offered by the plaintiff below. In taking such deposition on interrogatories, the plaintiff had asked this question : ££ What is the general reputation of said Cook as a steamboat captain 1” To this interrogatory the defendants objected, before the taking of the deposition, and at the trial also.
