Charles Garris appeals the motion court’s judgment overruling his Rule 24.035 motion without an evidentiary hearing. Specifically, Garris alleges that his constitutional rights to due process and to a jury trial were violated when the trial court overruled his pretrial motions challenging the validity of §§ 558.018.5(2)1 and 558.021.2, RSMo 2000.
